Terms of Use

Last updated October 16, 2026

These Terms of Use (the "Terms") are a legal agreement between you and Second Kick Moto LLC, an Idaho limited liability company ("Second Kick Moto," "we," or "us"). They govern the SK Maps iOS app, its paid features, and the map data, downloads, and other files and services we provide for it (together, the "App"). By installing, opening, or using the App, or by tapping to agree, you accept these Terms. If you do not agree, do not use the App. The website at secondkickmoto.com has its own site terms.

Who may use the App

You must be at least 13 to use the App. If you are under 18 (or the age of majority where you live), you may use it only with permission from a parent or legal guardian who agrees to these Terms for you. Children under 13 may not use the App.

Ride at your own risk

SK Maps is a planning and navigation aid for backcountry travel, an activity that is inherently dangerous and can result in serious injury, death, and loss of or damage to property. Any data the App shows, including maps, trails, roads, fuel locations, elevation, weather, water, fire, and land-status and access data, can be wrong, incomplete, or out of date. The App's routing, calculations (such as distance, climb, time, fuel range, and river readings), alerts, and display can contain errors. GPS and the device itself can be inaccurate, unavailable, or fail. A route the App draws is not an assurance that the route is passable, legal, or safe for you, your machine, or the conditions on the day.

You are responsible for your own navigation and safety decisions. Carry paper maps or another means of navigation, tell someone where you are going, check current land-management and closure information with the agencies that manage the land, and turn around when the ground in front of you disagrees with the screen. Do not look at or handle the phone while your vehicle is moving. Any voice, hands-free, or glanceable features the App offers do not change your responsibility to operate your vehicle safely and within the law, or to stop when attention to the App is needed.

The App is not an emergency, rescue, or communication service. Do not rely on it to call for help or to tell anyone where you are. Carry a satellite messenger or other means of contacting emergency services where cell coverage is unreliable.

YOUR USE OF THIS REAL-TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.

Assumption of risk and release

You understand and accept that backcountry and off-pavement travel involves risks that cannot be eliminated, including terrain, weather, water crossings, wildfire, wildlife, remoteness, mechanical failure, the acts of other people, and inaccurate or missing map, routing, elevation, weather, and conditions data. By using the App you voluntarily assume all of those risks, known and unknown, whether or not they are caused in part by the App or its data.

To the fullest extent permitted by applicable law, you release and discharge Second Kick Moto and its affiliates, members, managers, officers, employees, contractors, agents, licensors, data providers, successors, and assigns (the "Released Parties") from all claims, demands, and causes of action of any kind arising from or related to your use of the App, your travel, or your reliance on anything the App shows, including claims based on the negligence of a Released Party. This release does not cover liability that the law does not allow to be released.

Routes, closures, and the law

The App's planning modes decide where a route may go using only the data you have downloaded. Each mode tries to leave out routes that the downloaded land-management data the App uses, such as U.S. Forest Service and Bureau of Land Management data, lists, as of the date that data was captured, as closed to, or not open to, that type of travel. This is a best effort, not a promise: that data can be incomplete, out of date, or wrong, and the App can misread it. A limit that one source lists for its own mapped route is not applied to a road or trail drawn from a different source, even where the two run side by side. The App cannot check routes that the data it uses has no record of, routes on land managed by agencies, tribes, or private owners whose data it does not use, seasonal opening and closing dates, fire and emergency closures, permit or fee requirements, vehicle registration or equipment rules, or anything that changed after the data was published. A route the App draws, in any mode, is never a determination that you may legally travel it. The official maps and the signs posted on the ground govern, and you are solely responsible for knowing and obeying the rules where you ride.

Road, trail, access, land-status, and easement data in the App is reproduced from government publications that describe themselves as not legal documents and not survey quality. The official map, the recorded documents, and posted signs govern, and an easement drawn on the map does not grant access beyond the recorded road or trail.

Do not rely on the App for closure orders, fire restrictions, road reports, or other alerts. It may not show them, and no map can be current with all of them. Before every trip, it is your responsibility to check current closures, restrictions, and alerts with the agencies that manage the land and with the state's road-condition service for the roads you plan to use.

The data is a snapshot

Map, routing, place-name, and land-management data you download is a copy made on a particular date from public and other sources, some of which are edited by volunteers. It can be incomplete, wrong, or out of date on the day you download it. The App may refresh downloaded data when it is online, but nothing guarantees that what you have is current or complete. Weather, water, wildfire, air-quality, and other live data comes from outside services when the App can reach them and may be delayed, stale, or unavailable. We do not independently verify every route, condition, or data item, and we do not warrant any of it.

Third-party data and services

The App shows data and uses services from third parties, including OpenStreetMap (© OpenStreetMap contributors, ODbL), government agencies, open-data publishers, commercial cloud and hosting providers, and Apple. That data and those services are governed by their own terms, are credited in the App under Data & Credits, and are not ours to warrant. Any of them may change, slow, limit, or stop their service, or change their terms, at any time and without notice to us, and we may change which providers we use. A feature that depends on such data or a service may degrade or stop working as a result, and we are not responsible when it does.

No warranty

The App and everything in it are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, accuracy, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the App will be error-free, secure, or uninterrupted, that defects will be corrected, that it will work with any particular device or iOS version, or that any data it shows or any download it offers is correct, complete, or available.

Limitation of liability

To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for personal injury, death, property damage, becoming lost or stranded, citations or fines, loss of data, loss of use, or any other loss arising from or related to your use of or reliance on the App or its data, under any legal theory, even if we were told such damages were possible. Where liability cannot be excluded, the total liability of the Released Parties for all claims together is limited to the greater of the amounts you paid, through Apple, for SK Maps and its paid features in the twelve months before the event giving rise to the claim, or fifty U.S. dollars. Some jurisdictions do not allow some of these limits; in those places they apply to the fullest extent the law allows.

Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from any claim, demand, or proceeding brought by a third party, and from the resulting losses, damages, liabilities, and costs (including reasonable attorneys' fees), arising from or related to: your use of the App; any content you import, export, or share through the App; your breach of these Terms; your violation of any law or of the rights of others; or injury, death, or damage you cause to others, including through trespass or travel on closed or unauthorized routes. We may control the defense of any such claim, and you will cooperate with us.

Your content and your responsibilities

Content you create in the App is yours; we do not claim ownership of it. You are responsible for backing it up, using the export and backup options the App provides, and for anything you choose to export or share. We are not responsible for lost or corrupted data. Import only files you have the right to use. Nothing in the App may be used to plan or carry out anything unlawful. The Privacy Policy describes where your content is stored.

Subscription

SK Maps is free to download. Some features of the App ("paid features") are unlocked by an optional auto-renewing subscription or by the One-Time Unlock (below). The plan's name, length, price, and any free trial or introductory offer are shown in the App and the App Store before you buy, and those terms apply to your purchase. Payment is charged to your Apple Account when you confirm the purchase or when any free trial ends.

The subscription renews automatically at the price then shown in the App Store, unless you cancel at least 24 hours before the current period ends. Prices may change; Apple's rules on notice of a price change, and any consent it requires, apply. Manage or cancel the subscription in your Apple Account's subscription settings; deleting the App does not cancel it. Refunds are handled by Apple under Apple's policies.

If your subscription lapses, you can still view and export the content you created. Paid features, including downloaded maps, are unavailable until you resubscribe or buy the One-Time Unlock. Downloaded maps may stay on your device, but they may need to be downloaded again or updated.

The subscription is sold through Apple and is also governed by Apple's Licensed Application End User License Agreement and your Apple Account terms.

One-Time Unlock

Instead of subscribing, you can buy the One-Time Unlock, a single, non-renewing in-app purchase, at the price shown in the App Store when you buy. It unlocks, without a subscription fee, the paid features available through the subscription at the time you buy it, for as long as the App and those features remain available. We may offer new features, content, or services separately, with their own price, and the One-Time Unlock does not include them unless we say so when we offer them.

The One-Time Unlock is not a promise of continued development, of compatibility with future versions of iOS or of your device, of the continued availability of third-party data or services, of hosted map downloads, or of how long the App will be offered. Features, map data, and data providers can change or be withdrawn.

The One-Time Unlock is sold through Apple and is governed by the same Apple terms as the subscription. Refunds are handled by Apple; a purchase Apple refunds no longer unlocks the paid features. Buying the One-Time Unlock does not cancel an existing subscription; Apple keeps billing it until you cancel it in your Apple Account's subscription settings.

License and restrictions

Second Kick Moto grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the SK Maps app on Apple devices you own or control, for your own personal, non-commercial use, subject to these Terms and to Apple's Licensed Application End User License Agreement. All rights not expressly granted are reserved.

You may not, and may not help or allow anyone else to:

  • copy, modify, or create derivative works of the App, except as the law expressly allows;
  • decompile, reverse engineer, disassemble, or attempt to derive the source code of the App;
  • remove or alter any notices, attribution, or credits in the App;
  • rent, lease, sell, sublicense, share, or redistribute the App, your purchase, or access to its paid features, except as Apple's terms permit;
  • circumvent, disable, or interfere with any purchase check, download limit, or other technical measure in the App;
  • use automated means (scripts, bots, scrapers) to access, download, or copy our services, downloads, or hosted files beyond normal use of the App, or place an unreasonable load on them;
  • use the App to build a competing product or service, or for any commercial purpose we have not agreed to in writing;
  • use the App in violation of any law or of the rights of others.

The App's software, design, and the SK Maps name and logo belong to Second Kick Moto and are protected by copyright, trademark, and other laws. If you send us feedback or suggestions, we may use them without any obligation to you.

Open data and open source

Open data stays open. Some data in SK Maps comes from open and government sources under their own licenses, such as OpenStreetMap (Open Database License). The App also includes open-source software used under its own licenses. Data sources and software are credited in the App under Data & Credits. Nothing in these Terms limits any rights you have under an open-data or open-source license; those licenses govern that data and software. Our license to the App does not grant you any rights in third-party data or software beyond what its publisher grants.

Apple

You download the App from the App Store under Apple's standard Licensed Application End User License Agreement, which these Terms supplement. If these Terms conflict with Apple's agreement about Apple's rights or responsibilities, Apple's agreement controls. Apple is not a party to these Terms and is not responsible for the App or for providing support for it.

Updates, changes, and ending access

We may update the App from time to time, and we may require you to install an update, or to accept updated Terms, before you can keep using it. We may change, add, suspend, or discontinue the App or any feature, data source, provider, download, or service, in whole or in part, and change which features are free or paid, at any time. We may suspend or end your access to the App, its paid features, its downloads, or its online services if we reasonably believe you have broken these Terms, the law, or a third party's rights, or to protect the App, its data sources, or other riders.

Sections that by their nature should survive (including Ride at your own risk, Assumption of risk and release, Routes, closures, and the law, No warranty, Limitation of liability, Indemnification, License and restrictions, Governing law and disputes, and General) survive any end of these Terms or of your use of the App.

Governing law and disputes

These Terms are governed by the laws of the State of Idaho and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute arising from or related to these Terms or the App will be brought only in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of those courts. If the law where you live gives you rights that cannot be waived by contract, these Terms do not take them away. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

General

These Terms, together with the Apple terms they refer to, are the entire agreement between you and Second Kick Moto about the App and replace any earlier agreement or understanding. If we do not enforce a provision, that is not a waiver of it or of our right to enforce it later. If any part of these Terms is found unenforceable, it will be enforced to the extent the law allows and the rest still applies. You may not assign or transfer these Terms or your purchase, except as Apple's terms permit; we may assign them, for example to a successor of our business. We are not liable for any delay or failure caused by events beyond our reasonable control.

Changes to these Terms

We may update these Terms. The date above tells you when they last changed. We may require you to accept revised Terms before you keep using the App. Otherwise, continued use of the App after the date above means you accept the revised Terms.
