Terms of Use
Last updated October 18, 2026
These terms govern your use of the Dayseries iOS app, made by Second Kick Moto LLC. By using the app you agree to them. The website at secondkickmoto.com has its own site terms.
License and restrictions
Second Kick Moto LLC grants you a personal, non-exclusive, non-transferable, revocable license to use the Dayseries app on Apple devices you own or control, for your own personal planning, subject to these terms and to Apple's Licensed Application End User License Agreement.
You may not, and may not help or allow anyone else to:
- copy, modify, or create derivative works of the app, except as the law expressly allows;
- decompile, reverse engineer, disassemble, or attempt to derive the source code of the app;
- rent, lease, sell, sublicense, or redistribute the app;
- use the app in a way that breaks the law or interferes with anyone else's use of it.
The app's software, design, and the Dayseries name and icon belong to Second Kick Moto LLC.
Purchase
Dayseries is sold through Apple's App Store. Payment, refunds, and Family Sharing are handled by Apple under your Apple account terms.
Not advice
Dayseries helps you organize your days. It is not medical, mental-health, financial, legal, or other professional advice, and it does not diagnose or treat anything. Anything the app shows you, including AI features that run on your device, is a planning aid to be checked with your own judgment.
Your data
Everything you create in the app is stored on your device and in your own iCloud account, and it is yours. You are responsible for backing it up (the app writes backups to your iCloud Drive and offers export) and for anything you choose to export or share.
Calendar data you connect belongs to you and to the provider that hosts it — Apple, Google, or another account you have set up on your iPhone. Your use of those calendars is governed by their providers' own terms. Dayseries reads and changes calendar data only when you ask it to, and we have no access to it; see the Privacy Policy.
No warranty
The app and everything in it are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be error-free or uninterrupted, that reminders will fire, or that any sync, backup, or calendar operation will succeed.
Limitation of liability
To the fullest extent permitted by law, Second Kick Moto LLC and its members and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, missed appointments, or any other loss arising from your use of or reliance on the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim, or one hundred U.S. dollars ($100) if you paid nothing.
Indemnification
You agree to defend and hold harmless Second Kick Moto LLC and its members and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the app in violation of these terms or of any law.
Governing law
These terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Idaho.
Changes
We may update these terms; the date above tells you when. When we make a material change to these terms or to the Privacy Policy, the app asks you to agree to the updated version before you continue using it. We may also change or discontinue the app or any feature at any time. If any part of these terms is found unenforceable, the rest still applies.
